Terms of Service

By creating an account or using homanai, you ("Client," "you") agree to these Terms.

1. What homanai does

homanai is a content pipeline service. You drop files (photos, video, documents) into a folder or upload area assigned to you. Our system analyzes them and drafts outputs: website updates, social posts, menu changes and similar. Nothing is published to any website, social account, or third-party service without your authorization.

2. You authorize what goes live (important, read this)

You are in control of what gets published. Every item homanai drafts is held until you authorize it, and it is published only after you do. You are solely responsible for reviewing each item before you authorize it, and for the content of anything you authorize for publication, including its accuracy, its rights clearances, and its compliance with the rules of any platform it is posted to. We are not responsible for content you authorize.

3. Your content and your rights

• You own your content. You keep all ownership of files you drop and of the outputs published from them.
• You grant us a limited license to store, process, analyze, transform and, once you authorize it, publish your content solely to provide the service.
• You confirm you have the rights to every file you upload and to publish the resulting outputs, including any people, logos, trademarks or third-party material shown.
• We do not sell your content, and one client's content is never mixed with, used to train on, or exposed to another client. This is a hard operating rule.
• Archive: we retain your original files as an archive for the life of your account so nothing is lost. On account closure you may request export or deletion (see the Privacy Policy).

4. Plans, billing and renewal

• Paid plans and prices are as shown at signup (Starter, Growth and Scale, and any managed-service tiers). Fees are billed in advance through our payment processor, Stripe.
• Subscriptions renew automatically each billing period until cancelled. You may cancel anytime through your billing portal; cancellation takes effect at the end of the current paid period.
• Data allowances and overage: each plan includes a storage allowance. Usage past the allowance is billed as metered overage at the posted rate ($5 per started 10 GB block). Your account shows usage before it bills.
• Fees are non-refundable except where required by law. Prices may change on reasonable notice before a renewal.
• Failed or past-due payment may result in suspension of publishing and uploads after notice; your archived content is retained during a reasonable cure period.

5. Acceptable use

You will not use homanai to upload or publish content that is unlawful, infringing, deceptive, or that violates a third-party platform's rules. We may suspend or terminate accounts that do.

6. Service availability

We work to keep the service running but do not guarantee uninterrupted or error-free operation. Publishing depends in part on third-party platforms whose availability and rules we do not control.

7. Disclaimers

The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-drafted output is accurate or fit for any purpose; your authorization is the safeguard, and that decision is yours.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

9. Indemnification

You will indemnify and hold us harmless from claims arising out of content you uploaded or authorized for publication, your breach of these Terms, or your violation of any law or third-party right.

10. Termination

Either party may terminate with notice. On termination we stop processing and, on request, export or delete your content as described in the Privacy Policy.

11. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.

12. Changes

We may update these Terms on reasonable notice. Continued use after an update means you accept the revised Terms.
